THE. THEY MEET EVERY TWO YEARS, AND ALL THE CITIES COME TOGETHER TO HAVE A LEGISLATIVE AGENDA. SO I JUST WANTED TO ADVISE COUNCIL AND STAFF THAT WE NEED TO PREPARE FOR THIS NEXT LEGISLATIVE SESSION.
I'D LIKE TO SEE IF WE CAN HAVE A FORUM SO WE CAN START CRAFTING OUR LEGISLATIVE AGENDA.
A LOT OF CITIES ARE ALREADY DEFINING THAT HTML HAS COME UP WITH THEIR LEGISLATIVE AGENDA. I THINK IT'S GOOD THAT WE LOOK AT IT, BUT THAT WE ALSO TAKE INTO ACCOUNT ANY, ANY ITEMS, ANY ISSUES THAT WE NEED TO ADVOCATE IN AUSTIN, BECAUSE IT'S NOT JUST ABOUT FUNDING, IT'S ALSO ABOUT LAWS THAT ARE PASSED THAT MAY AFFECT HOW WE PROVIDE OUR SERVICES TO OUR RESIDENTS.

WHEREAS IN 2023, THE SOUTH TEXAS BRONX SOFTBALL TEAM TRAVELED TO PLANO, TEXAS, TO COMPETE IN THE FAST PITCH AMERICAN SOFTBALL ASSOCIATION FAR SOUTHERN NATIONALS CHAMPIONSHIP AND WON FIRST PLACE.
THEY ATTENDED THE 2024 WORLD SERIES CHAMPIONSHIPS FROM JULY 15 TO 20, 2024, IN BRANSON, MISSOURI, AND WON FIRST PLACE IN THE 14TH DIVISION.
THIS MARKS BACK TO BACK NATIONAL CHAMPIONSHIPS TWO YEARS IN A ROW.
AND WHEREAS THE SOUTH TEXAS BRONX IS A FAST PITCH SOFTBALL TEAM COMPOSED OF ATHLETES FROM THE EDINBURG CONSOLIDATED INDEPENDENT SCHOOL DISTRICT, BELLE GARCIA MIDDLE SCHOOL, SOUTH MIDDLE SCHOOL, AND BARRIENTOS MIDDLE SCHOOL, TAKING ON THE NAME OF THE CITY'S ORIGINAL UTPA BRONCS. THE TEAM CONSISTS OF SAVANNA FARFAN, ADDISON CANTU, ACA TREVINO, JERELYN MÉNDEZ, JUDITH ARROYO, MICAELA FLORES, OLIVIA REALE, NATALIE DIAZ, CLARISSA RODRIGUEZ, KATARINA CEPEDA, SADA GARZA, CHLOE AND CHLOE RAMIREZ.

MISSOURI, AS A FIRST YEAR, 14 TEAM COACHES KNEW THE COMPETITION WAS GOING TO BE STRONG. FACING ATHLETES FROM ALL OVER THE NATION, THEY WERE AWARE THAT THIS WOULD BE AN UPHILL BATTLE AS THEY FACED SECOND YEAR, 14 NEW TEAMS WITH OLDER GIRLS.BUT THE BRONX WERE UP TO THE CHALLENGE.
AND WHEREAS THE GIRLS BEGAN THEIR TOURNAMENT WITH AN EARLY BRACKET LOSS TO A VERY SEASONED ARKANSAS SECOND YEAR TEAM WITH THEIR BACKS AGAINST THE WALL, THE BRONX PLAYED TOUGH, EARNING THEIR SPOT IN THE NATIONAL CHAMPIONSHIP GAME, ONLY TO MEET UP WITH THE SAME TEAM THAT HANDED THEM THEIR FIRST LOSS.
AND WHEREAS THE SOUTH BRONX WENT INTO THE CHAMPIONSHIP GAME AS THE UNDERDOG TEAM, COACHES AND PLAYERS KNEW THAT IF THEY WERE TO COME OUT CHAMPIONS, THEY WOULD HAVE TO BEAT THE UNDEFEATED TEAM NOT ONCE, BUT TWICE, PER FORZA. WORLD SERIES RULES.
WHEREAS THE SOUTH BRONX WENT INTO THE CHAMPIONSHIP GAME WITHOUT FEAR AND INSTEAD WERE DETERMINED TO LEAVE THEIR MARK IN MISSOURI, FIGHTING AND SACRIFICING EVERY MINUTE OF THE GAME, THEY BEAT THE UNDEFEATED SECOND YEAR ARKANSAS TEAM TWO GAMES IN A ROW TO BECOME THE 2024 WORLD SERIES CHAMPIONS.
AND WHEREAS THE CITY COUNCIL, THE CITY OF EDINBURG IS PROUD TO RECOGNIZE THE ACHIEVEMENTS OF THE SOUTH TEXAS BRONX SOFTBALL TEAM AND COACHES JUAN RODRIGUEZ, PETER CANTU, AND JORGE ARROYO FOR EARNING THE 2024 NATIONAL TITLE AND MAKING THEIR SCHOOL, FAMILY AND CITY PROUD.

THIS TEAM'S ORIGINS BEGAN AND ORIGINATED IN EDINBURGH, WHERE THE EDINBURGH PARKS AND REC SOFTBALL PROGRAM. TAKING OUR NAME AND OUR COLORS FROM THE ORIGINAL MASCOT FROM OUR PREVIOUS UTPA BRONCS PROGRAM.
I MEAN, WHAT A BETTER MASCOT TO REPRESENT OUR CITY THAN THE ORIGINAL MASCOT, BUCKY THE BRONC. COACH CANTU AND I BEGAN AS VOLUNTEER COACHES FOR PARKS AND REC OVER FIVE YEARS AGO, AND EACH OF OUR YOUNG ATHLETES HERE TODAY WERE PLAYERS THAT CAME THROUGH PARKS AND REC PROGRAM, AND THAT WE COACHED BACK WHEN WE WERE STARTING IN THE CITY SOFTBALL LEAGUE. THESE GIRLS, SINCE THEY WERE EIGHT YEARS OLD, HAVE BEEN CONSISTENTLY PRACTICING DAY IN AND DAY OUT, WEEK IN AND WEEK OUT.
FOR THE PAST SIX YEARS, THEY'VE BEEN PUTTING IN WORK, CONSISTENTLY ATTENDING PRACTICES, FUNDRAISERS ON OUR OWN TO BE ABLE TO GO AND REPRESENT OUR CITY AND OUR TEAM AT THESE NATIONAL TOURNAMENTS, PLAYING, COMPETING AGAINST TEAMS FROM ALL OVER THE NATION TO BE ABLE TO BRING BACK HOME NATIONAL CHAMPIONSHIP TROPHIES BACK TO BACK IN 2023 AND 2024.
THIS IS TRULY A BLESSING AND A TESTAMENT TO THEIR HARD WORK, DEDICATION AND COMMITMENT TO THE SPORT.
BUT TO SAY THAT WE DID IT ALL ON OUR OWN WOULD BE A LIE.
OUR COMMUNITY HAS ALWAYS PLAYED A MAJOR ROLE IN OUR SUCCESS.
AS WE ALL KNOW, FUND RAISING FUNDS IS NOT AN EASY TASK.
YET THESE GIRLS HAVE ALWAYS HAD THE SUPPORT FROM NOT ONLY OUR FRIENDS AND FAMILY, FROM OUR CITY RESIDENTS WHO ALWAYS COME OUT AND SUPPORT THESE GIRLS AT EVERY EVENT WE HAVE. IT'S A HUMBLING EXPERIENCE FOR US WHEN WE SEE THE LOVE AND SUPPORT OUR COMMUNITY HAS IN OUR GIRLS. PLEASE NOTE THE PUBLIC COMMENT PERIOD IS NOT INTERACTIVE. THE COUNCIL MAY NOT RESPOND TO PUBLIC COMMENTS. THE FIRST PUBLIC COMMENT MAYOR AND COUNCIL IS FOR CLARITY REGARDING TAXPAYERS MONEY. WE WELL, WE ARE HERE IN ANOTHER CITY MEETING WHERE YOU'RE GOING TO TELL US THAT WE CAN HAVE ANYTHING WE WANT BECAUSE THE PEOPLE OF EDINBURG HAVE GREAT CREDIT.
YOU'RE GOING TO TELL US THAT EVEN THOUGH WE ARE IN A RECESSION AND THE PRICES OF FOOD AND GAS ARE INCREASING, WE SHOULD BE JOYFUL BECAUSE WE HAVE A WAY OF GIVING PEOPLE EVERYTHING WE WANT. YOU'RE GOING TO TELL US THAT EVEN THOUGH THE CITY HAS A $280 MILLION DEBT, AND THAT MEANS THAT EVERY MAN, WOMAN AND CHILD HAS A DEBT OF $3,000.
THAT IS OKAY. IT'S ALL OKAY BECAUSE THE 2025 THREE MEMBERS OF THIS COUNCIL ARE RUNNING FOR REELECTION, AND THEY NEED TO SHOW PROGRESS.
SO IF WINNING MEANS THAT THE CITY DEBT MUST BE DOUBLED AND SOME PEOPLE WILL LOSE THEIR HOMES BECAUSE THEY CAN'T PAY THE TAXES, THAT IS THE PRICE OF PROGRESS TO ME.
YOU SHOULD LOWER THE TAX RATE AND THAT WOULD MAKE THE VOTERS VERY HAPPY.
HOW IS EVERY INCREASING THE PRICE OF WATER BY 67% GOING TO IMPROVE THE COMMUNITY IF THAT DOES NOT INCLUDE MORE WATER? THE ANSWER IS SIMPLE IF YOU INCREASE THE COST OF WATER, YOU CAN USE THE MONEY TO PAY FOR THE BONDS AND THE COUNCIL CAN SAY IT DID NOT RAISE TAXES. THE PROBLEM IS THERE IS STILL NO MORE WATER AND NOW THERE IS MUCH HIGHER DEBT.
THIS TRICK FOR TAKING MORE FROM THE PEOPLE IS COSTING INDIVIDUALS $350,000 A MONTH, OR $4,200,000 A YEAR. BUT IT MAY BRING MORE POLITICAL CONTRIBUTIONS TO YOUR CAMPAIGNS.
AND AGAIN, LIKE I SAID, IF YOU WANT TO MAKE POINTS WITH THE VOTERS, LOWER THE TAX RATE. ALSO TONIGHT I HAVE SIGNED UP FOR EIGHT B.
I'M HOPING AND PRAYING THAT YOU WILL PASS THE ORDINANCE THAT THEY HAVE BROUGHT TONIGHT, AS THEY ARE. AND I WOULD ALSO LIKE TO ASK EVERYONE TO PRAY FOR ISRAEL AND FOR THE HOSTAGE FOR ISRAEL TO WIN THIS BATTLE, AND THAT BECAUSE THEY ARE AN ALLY TO THE UNITED STATES AND THEY ALWAYS HAVE BEEN.

I STAND HERE TO DISCUSS AN IMPORTANT ISSUE THE OVERSIGHT OF THE RECORD ROTATION LIST.SPECIFICALLY, I WANT TO EXPLAIN WHY I BELIEVE THAT BEING JUDGED BY A JUDGE, RATHER THAN HAVING OVERSIGHT BY THE CHIEF OF POLICE, IS THE BETTER APPROACH FOR MANAGING THIS CRITICAL ASPECT OF OUR COMMUNITY SERVICES.
FIRST AND FOREMOST, JUDICIAL OVERSIGHT ENSURES IMPARTIALITY.
JUDGES ARE TRAINED TO INTERPRET THE LAW BASED ON EVIDENCE, FACTS AND LEGAL PRINCIPLES.
THEIR DECISIONS ARE GUIDED BY THE RULE OF LAW, NOT BY OPERATIONAL PRESSURES OR DEPARTMENTAL PRIORITIES.
THIS IMPARTIALITY IS CRUCIAL WHEN DEALING WITH THE RECORD ROTATION, WHICH INVOLVES NOT ONLY LAW ENFORCEMENT BUT ALSO SIGNIFICANT BUSINESS INTERESTS.
HAVING A JUDGE OVERSEE DISPUTES OR DECISIONS RELATED TO THIS LIST ENSURES THAT EVERY PARTY INVOLVED, WHETHER A WRECKER SERVICE PROVIDER OR A CITIZEN, RECEIVES A FAIR AND UNBIASED HEARING.
ON THE OTHER HAND, WHEN THE CHIEF OF POLICE OVERSEES THE WRECKER, ROTATION IS THERE IS A POTENTIAL FOR CONFLICTS OF INTEREST OR PERCEIVED BIAS.
THE POLICE DEPARTMENT'S PRIMARY FOCUS IS LAW ENFORCEMENT, NOT BUSINESS REGULATION.
WHILE THE POLICE ARE EXPERTS IN MAINTAINING PUBLIC SAFETY, THEIR INVOLVEMENT IN REGULATING THE RECORD ROTATION LIST CAN BLUR THE LINES BETWEEN ENFORCING THE LAW AND MANAGING COMMERCIAL OPERATIONS.
THIS CAN LEAD TO DECISIONS THAT MIGHT FAVOR CERTAIN PROVIDERS, OR THAT ARE MADE BASED ON FACTORS OTHER THAN STRICT ADHERENCE TO FAIRNESS AND LEGALITY.
ANOTHER KEY POINT IS THAT JUDGES BRING A WEALTH OF LEGAL KNOWLEDGE AND EXPERIENCE TO THEIR DECISIONS. THEY ARE EQUIPPED TO HANDLE COMPLEX LEGAL ISSUES THAT MAY ARISE IN DISPUTES OVER THE RECORD ROTATION LIST, INCLUDING CONTRACT LAW, DUE PROCESS, AND FAIRNESS IN ADMINISTRATIVE ACTIONS.

THIS COULD INADVERTENTLY LEAD TO DECISIONS THAT, WHILE OPERATIONALLY EXPEDIENT, MIGHT NOT FULLY RESPECT THE LEGAL RIGHTS OF THE RECORD COMPANIES OR THE INDIVIDUALS AFFECTED.
TRANSPARENCY IS ANOTHER CRITICAL FACTOR.
JUDICIAL PROCEEDINGS ARE OPEN AND TRANSPARENT, PROVIDING ALL PARTIES WITH A CLEAR UNDERSTANDING OF HOW DECISIONS ARE MADE. THIS TRANSPARENCY HELPS TO BUILD TRUST IN THE PROCESS, AS EVERYONE INVOLVED CAN SEE THAT DECISIONS ARE BEING MADE BASED ON LEGAL STANDARDS AND ARE OPEN TO SCRUTINY.

I WANT TO BEGIN BY EMPHASIZING THE SIGNIFICANT INVESTMENT THAT MYSELF AND OTHERS IN THE RECORD INDUSTRY HAVE MADE TO MEET THE CURRENT REQUIREMENTS OF THE ORDINANCE. TO COMPLY WITH THESE REGULATIONS, I HAVE INVESTED THOUSANDS OF DOLLARS INTO MY BUSINESS. THIS INCLUDES PURCHASING SPECIALIZED EQUIPMENT, MAINTAINING A FLEET OF RECORDS, ENSURING THAT MY TEAM IS FULLY TRAINED AND COMPLIANT WITH ALL NECESSARY CERTIFICATIONS, AND ADHERING TO THE STRINGENT STANDARDS SET BY THE ORDINANCE.
THESE INVESTMENTS WERE MADE IN GOOD FAITH, WITH THE UNDERSTANDING THAT AS LONG AS WE MET THE CRITERIA, WE WOULD REMAIN ON THE ROTATION LIST AND CONTINUE TO SERVE OUR COMMUNITY TO NOW FACE THE POSSIBILITY OF BEING REMOVED FROM THE ROTATION LIST, DESPITE MEETING ALL THE REQUIREMENTS IS SIMPLY INCONCEIVABLE.
IT UNDERMINES THE TRUST AND CONFIDENCE THAT WE AS BUSINESS OWNERS HAVE PLACED IN THIS PROCESS. WE HAVE PLAYED BY THE RULES, INVESTED HEAVILY IN OUR BUSINESSES AND BUSINESSES, AND OPERATED WITH THE EXPECTATION THAT OUR EFFORTS WOULD BE RECOGNIZED AND REWARDED BY CONTINUED INCLUSION ON THE ROTATION LIST. THIS REDUCTION COULD COMPROMISE THE QUALITY AND TIMELINESS OF THE SERVICE THAT THE PUBLIC EXPECTS AND DESERVES.MOREOVER, THE RATIONALE FOR REDUCING THE NUMBER OF WORKERS SEEMS UNCLEAR AND LACKS TRANSPARENCY. DISCUSSIONS OF THIS MAGNITUDE SHOULD NOT BE MADE WITHOUT THOROUGH ANALYSIS AND INPUT FROM ALL STAKEHOLDERS, PARTICULARLY THOSE WHO WILL BE DIRECTLY AFFECTED. IF THIS DECISION IS BEING DRIVEN BY THE CHIEF OF POLICE, I WOULD URGE THIS COUNCIL TO CONSIDER WHETHER SUCH A REDUCTION IS TRULY IN THE BEST INTEREST OF PUBLIC SAFETY AND SERVICE EFFICIENCY, OR IF IT MIGHT INADVERTENTLY FAVOR CERTAIN OPERATORS AT THE EXPENSE OF OTHERS WHO HAVE ALSO INVESTED HEAVILY TO MEET THE CURRENT ORDINANCES REQUIREMENTS.
THE PROPOSED REDUCTION IS NOT JUST A MATTER OF BUSINESS, IT IS A MATTER OF FAIRNESS AND EQUITY.
TO REMOVE RECORD COMPANIES FROM THE ROTATION LIST AFTER THEY HAVE COMPLIED WITH EVERY REQUIREMENT IS NOT ONLY UNJUST, BUT ALSO HARMFUL TO THE LIVELIHOODS OF THOSE BUSINESS OWNERS AND THEIR EMPLOYEES.
IT SENDS A MESSAGE THAT INVESTMENTS AND ADHERENCE TO REGULATIONS CAN BE DISREGARDED, WHICH IS A DANGEROUS PRECEDENT TO SET.
I STRONGLY URGE THIS COUNCIL TO REDUCE, TO REJECT THE PROPOSAL TO REDUCE THE NUMBER OF RECORDS ON THE ROTATION LIST.

THE PROPOSED ORDINANCE SETS A TROUBLING PRECEDENT BY ALLOWING TRACTOR TRUCK RECORDS TO CHANGE LIMITLESS FEES, WHILE AT THE SAME TIME CAPPING THE FEES FOR SMALLER RECORDS AT A RATE THAT IS UNFAIR AND UNSUSTAINABLE.
THIS DISPARITY CREATES AN UNEVEN PLAYING FIELD THAT DISPROPORTIONATELY DISADVANTAGES SMALL RECORD OPERATORS WHO ARE ALREADY STRUGGLING TO MEET THE COST OF PROVIDING QUALITY SERVICE UNDER INCREASINGLY DIFFICULT CONDITIONS.
THIS KIND OF IMBALANCE IS NOT JUST UNFAIR, IT'S LEGALLY QUESTIONABLE.
BY PERMITTING LIMITLESS FEES FOR ONE GROUP WHILE RESTRICTING ANOTHER, THE CITY OF EDINBURGH IS OPENING ITSELF UP TO POTENTIAL LAWSUITS.
THESE LEGAL CHALLENGES COULD BE COSTLY AND DAMAGING, BOTH FINANCIALLY AND IN TERMS OF THE CITY'S REPUTATION.
IT IS ESSENTIAL THAT WE AVOID CREATING A SITUATION WHERE THE CITY IS FORCED TO DEFEND ITSELF IN COURT OVER AN ORDINANCE THAT COULD HAVE BEEN REVISED AND IMPROVED FROM THE START. PASSING THIS ORDINANCE, AS IT IS CURRENTLY STANDS, WOULD BE A MISTAKE. IT WOULD NOT ONLY HARM SMALL OPERATORS, BUT ALSO EXPOSE THE CITY TO UNNECESSARY LEGAL RISKS.
INSTEAD OF MOVING FORWARD WITH A FLAWED ORDINANCE, WE SHOULD TAKE THE TIME TO REVISE IT, ENSURING THAT IT IS FAIR, EQUITABLE AND LEGALLY SOUND.
I STRONGLY URGE THIS COUNCIL TO NOT PASS THE PROPOSED ORDINANCE IN ITS CURRENT FORM.
WE NEED TO PAUSE, REVISIT THE FEE STRUCTURE AND INVOLVE ALL STAKEHOLDERS, PARTICULARLY THOSE IN THE RECORD INDUSTRY, WHO WILL BE MOST AFFECTED BY THESE CHANGES AND THE REVISION PROCESS.
BY DOING SO, WE CAN CREATE AN ORDINANCE THAT SERVES THE INTEREST OF ALL PARTIES FAIRLY AND PROTECTS THE CITY FROM POTENTIAL LEGAL CHALLENGES.

WE MUST TAKE THE TIME TO ENSURE THAT ANY LEGISLATION WE PASS IS ACCURATE AND FREE FROM FLAWS. WHAT FLAWS? WHAT CONCERNS ME EVEN MORE IS THAT THIS ORDINANCE WAS NOT REVIEWED BY ANYONE IN THE RECORD INDUSTRY, THE VERY PEOPLE WHO WILL BE MOST DIRECTLY AFFECTED BY IT. IN THE MILITARY, WE ALWAYS INVOLVE SUBJECT MATTER EXPERTS WHEN MAKING DECISIONS THAT WILL IMPACT SPECIFIC OPERATIONS.
WE RELY ON THE EXPERTISE TO GUIDE US AND TO ENSURE THAT OUR PLANS ARE SOUND.
SIMILARLY, THE RECORD INDUSTRY PROFESSIONALS HAVE INVALUABLE INSIGHTS AND EXPERIENCE THAT COULD HAVE CONTRIBUTED TO MAKING THIS ORDINANCE MORE EFFECTIVE AND EFFICIENT. THEIR ABSENCE IN THIS PROCESS IS SIGNIFICANTLY AND OVERSIGHT.
THE RECORD INDUSTRY OPERATES UNDER UNIQUE CHALLENGES AND DEMANDS THAT THOSE OUTSIDE OF IT MAY NOT FULLY GRASP.
WITHOUT INPUT FROM THE INDUSTRY EXPERTS, THERE IS A REAL RISK THAT THIS ORDINANCE WILL BE INEFFICIENT, IMPRACTICAL, PERHAPS EVEN COUNTERPRODUCTIVE.
WE SHOULD NOT RUSH TO PASS LEGISLATION THAT HAS NOT BEEN FULLY VETTED BY THOSE WHO KNOW THE INDUSTRY BEST. AS A VETERAN, I KNOW THAT THE MOST SUCCESSFUL MISSIONS ARE THOSE WHERE EVERY POSSIBLE OUTCOME HAS BEEN CONSIDERED AND EVERY POTENTIAL ISSUE HAS BEEN ADDRESSED BEFORE. BEFORE MOVING FORWARD, WE MUST APPLY THE SAME LEVEL OF DILIGENCE AND THOROUGHNESS TO OUR LEGISLATIVE PROCESS.
BY DELAYING THE PASSAGE OF THIS ORDINANCE, WE ALLOW OURSELVES FROM THE TIME TO BE CORRECTED FROM THE ERRORS, GATHER INPUT FROM THE RECORD INDUSTRY, AND ENSURE THAT THE FINAL ORDINANCE IS ONE THAT TRULY SERVES THE NEEDS OF OUR COMMUNITY.
THIS IS NOT ABOUT HALTING PROGRESS.
IT IS ABOUT MAKING SURE THAT WHEN WE DO MOVE FORWARD, WE DO WITH CONFIDENCE, KNOWING THAT WE'VE DONE EVERYTHING POSSIBLE TO GET IT RIGHT.
